The federal District Judge in San Diego said the pharmacy chain, which sells prescription drugs to Americans for the treatment of erectile dysfunction, would have to start selling the drug for a fee. The pharmacy would be required to provide the prescription to its customers, but would be reimbursed based on price.
In a decision today, Judge Rebecca Doherty of the San Diego County Superior Court ordered the chain to stop selling the drug until the pharmacy receives approval from the FDA, adding that the drug would not be available in a single-serving, single-dose container.
"We are troubled by the FDA's actions in not informing the patients, pharmacists and the pharmacies that the drug is available as a generic drug," Doherty said. "This action is an infringement of the federal law."
She added that the pharmacy would have to submit the prescription to the FDA before the drug would be available to them. "The Food and Drug Administration requires that pharmacies sell the drug under the brand name Pfizer," Doherty said. "The fact that the FDA has not approved the prescription drug, that Pfizer has not approved the prescription, is a direct violation of our law."
Judge Doherty said that the pharmacy had a duty to act as the "supervirus" within the pharmacy's authority and would be charged with complying with the prescription. She said the pharmacy would not be reimbursed based on the price of the prescription.
"There is a strong, strong need for the pharmacy to comply with the prescription," Doherty said. "That is why we are holding the pharmacy responsible for the sale of the prescription drug. We are not holding it up for any abuse."
Judge Doherty said that the prescription would be filled by the pharmacy to be available at a cost that is not more than $100 for one day, and the pharmacy would be reimbursed on an as-needed basis.
